| 1.0 Standard Design / Development features: |

Web Media |
|
Through meetings and conferences we develop a
“theme” for your site or web media when applicable.
We then develop an outline of best use business
categories, which will determine your navigation.
Once these two items are approved we design a “comp”
of your home page and a sample sub page and post it
to our web site for approval or revisions. After
final approved text is received your site is then
“coded” into a working sample on our test server.
After all parties review text to locate any errors,
bugs or inconsistencies (it happens) a final site is
approved and uploaded. • Home page/sub page concept and variations of concept based on agreed direction, with 2 revisions for concept optimization. Multiple concepts (Separate and uniquely different from agreed concept), if you prefer to view multiple ideas before choosing a direction. Custom illustration and/or image enhancements/repairs are additional. One additional round for text revisions is started if needed after test site is posted. • CSS Stylized text and header layout for provided approved text. Text to be submitted via “zipped” feel containing all documents listed by title in approved outline. | 1.1 Image Selection & Content Submittal |

Image Selection is a critical part of the design
process. Your contract is budgeted for client
provided/paid digital images. Once images are
selected, we can purchase them for you at an
additional cost for time and expenses. There are
several ways to get the images you need to enhance
your corporate image: • Digital Royalty Free or Rights-managed images via several of our recommend web sites. • Photo Shoots – Billed hourly for photographer and models. • Custom Illustration, Renderings of a Defined Object – MAZAYADESIGN can create a desired image in 3D or as an illustration to get that unique look of hard to capture imagery/scenes. Additional costs apply. |
| 1.2 Submitting Technical Copy |
|
Your technical copy should describe the core of each
category in your outline with the insight that
usually only comes from the “inside”. We understand
that nobody knows your company, products and
services better. We are looking for the technical
description for each area in your approved outline,
and if you have purchased optimization services
(*highly recommended) we will then enhance your
message to be as compelling as possible, and
conclude the text with action calls. Please wait until you have accumulated all the technical copy, form text, links, etc. and submit in one ZIP file with each WORD document being properly labeled according to the approved outline…as it will assist in the management and timeliness of your project. We cannot accept files in any other format. Please make sure not to send bits and pieces of information that may apply to a relevant category, rather make sure it covers the complete subject, as copy enhancement and persuasion architecture is not full discovery and turnkey copywriting. This is available, but will require interviews, research, technical writing, approval of technical writing and then marketing and persuasive architecture. Needless to say the cost is significantly higher, however most companies are able to provide accurate technical information, thus saving this unnecessary step, and saving thousands. *If you have any questions we will be glad to walk you through the process of submitting your text so your project is not delayed. This process was created to track and manage your projects and streamline your development time. |
| 1.4 Marketing Optimization & Architecture |
| Upon receiving your technical copy, our job will be to enhance the document’s effectiveness and marketing message using headers, sub headers, revised body treatment, visual structuring, benefit oriented bullets and key points, calls to actions, etc. We call this Persuasive Architecture, or more simply, marketing optimization. We will then resubmit this information back to you for approval of the content; however at this time the document will not be proofed. |
| 1.5 Copy, Creative & Usage Rights |
| MazayaDesign maintains certain rights to all of our designs. Client maintains ownership of designs contracted for its original and intended use only. We will provide you with a “flattened” copy of your job upon request. Creative and Marketing ideas belong to MazayaDesign and may be used only as specifically contracted for. Written permission must be granted by MazayaDesign for any other use of ideas, copy or “live” graphic files. |
| 1.6 Proofs & Final Output (applicable on print jobs)> |

Due to the various types of color builds,
MAZAYADESIGN would like to call to your attention
that all colors and proofs viewed as match prints,
on screen, or sample printouts may not match your
final product exactly. A signed proof is required on
all projects prior to production. MAZAYADESIGN is
not accountable for unsigned proofs or verbal
authorizations. |
| 1.7 Late & Legal Fees |
| Legal fees and late fees are applied monthly to all bills 30 days past due. Late fees are 2% of contract total, and are applied monthly until account is paid in full. MazayaDesign reserves the right to collect full legal fees, should legal action be required to secure a debt. Client authorizes use of small logo/web address for MazayaDesign on print pieces, web sites and e-mails for the purpose of identifying the designer (MAZAYADESIGN). |
| 1.8 Completion Dates & Rush Charges |
| All projects will be completed ASAP, as the process allows. All content and materials that are needed must be provided to MAZAYADESIGN before a timeline can be issued. If you need a firm due date, we can note it in your contract, however RUSH fees may apply. Rush charges vary with each project and the amount of time allotted, ranging from 25-200%. |
| 1.9 Cancellation/Legal |
| Either party may cancel this contract at any time. If a project is canceled after the start of creative ideas and marketing direction and/or design services have been discussed, the initial and all subsequent payments made or due shall be forfeited. Neither party in any circumstances shall be held liable for alleged loss of income or other damages that exceed the scope of work. Disputes are to be settled by independent arbitration. |
| 1.10 Payment Terms |
| MazayaDesign requires a 50% non-refundable payment to initiate a new project, a 25% payment upon approval of each relative design concept, and the 25% balance due upon completion. For printing, hourly contracts, hosting, and consulting, MazayaDesign requires a 25%-50% payment with either the balance due upon delivery or monthly billings as described in this document. MAZAYADESIGN reserves the right to require payment by cashiers check or money order. |
| 1.11 Subsequent Orders |
|
Any and all requests or new projects ordered are
subject to the same terms and conditions of this
document and do not require another signature and
document. *Images provided or downloaded can be either ready to use as is, or require a lot of work. If your chosen image needs customization other than sizing or coloring it will incur additional charges. For example: removing interfering backgrounds, removing glares and imperfections, silhouetting, etc. Charts, PowerPoint Docs, graphs, etc. are assumed to be ready to use, customization or re-rendering of these documents is extra, unless specifically referred to in your contract. **Outsourcing includes fulfilling requested services outside the direct scope of you contract or without a separate invoice. Examples may include mailing coordination and distribution, photography custom printing, binding, telemarketing, copying, etc. We will secure a fair rate and will arrange for you to pay our vendor directly or if you prefer we can simply bill you for the full amount of the provided service plus our 25% fee. |

and client responsibilities, these timelines are
subject to change and are not guaranteed. |
